An awful thing to happen to a lovely design

I follow the blog of Tula Pink, a lovely lady who produces gorgeous designs and shares her entire design process. She has recently posted this page: http://tulapink.com/2010/09/19/outraged/ to show the awful knock off fabric that they're selling in Walmart without her knowledge or permission.

She is obviously very upset and distressed and I would urge you all to pass this around and show your outrage at a huge company treating an independent designer so badly.

OMG! I cant believe such a large company would behave in such a disgusting way. They should be truely ashamed of themselves for treating a talented designer with such disrespect. I hope she manages to put a stop to this.

JR where is this lady located, can she not invoke copywrite law to stop them? In Australia copywrite is automatic, you don't need to apply for it nor use the symbol to show it. That would be an automatic breach here with costs against Walmart, no questions asked so long as she could show that it is her design.

Hmm, I have just read through the blog article, I so hope Moda throw the book at them, they should be large enough to. Oh and I can't spell today for some reason.

Copy rights only last 20 years. Then you have to reinstate them or they go to public domain. Then anyone can use them. But you are right, Moda should be able to help. I'm sure they had an agreement with her in writing to prove it's hers.
If you ever read the book about Sam walton(walmart owner) you will see he made a habit of "borrowing" someone else's things. He was famous for it. It's just not right. It's bad enough when a country like China steals our stuff, but for a company that belongs to the USA to do it to they're own, it's just not right.

I guess I shouldn't automatically presume the designer is an american. Forgive me for that. But it's still not right to take someone else's design!

The designer is American and I think the design is just a couple of years old so she should be able to sue. From the sound of it on her blog she's staying out of it because she's worried that she'll say something in a fit of anger that she regrets later but Moda are on the case.

Good I'm glad Moda is involved. That helps cause they are big enough to have pull. I just hope they wern't the ones who sold it to WM.

The sad thing is Walmart would even be what it is today had it not been the bully that it is. It kills small bussiness and doesnt even think twice. Let alone steal from others. The only thing for us to do is stop shopping there.

Ugh blasted Walmart ! I have to be desperate to go in there and it's usually with a lot of kicking and screaming going on. I hope things come out on her side!!!

Our Walmart discontinued the fabric department, so no fear of me buying this awful copy!! Actually makes me glad that they don't have fabric anymore, if all they have are knockoffs. I'd rather drive the 45 minutes to get to JoAnn's or the quilt shops!! No place to buy fabric in this area anymore!! Grrr!!! lol

                            Wow, that is appalling!

I hope Moda sorts it out lickety split and Walmart has to PAY.
